Meeting “The role of the notary in the exercise of the legal capacity of persons with disabilities”

The United Nations Special Rapporteur on the Rights of Persons with Disabilities, Ms. Catalina Devandas Aguilar, and the Human Rights Commission of the UINL are organizing a technical meeting on the role of the notary in upholding the right of persons with disabilities to exercise legal capacity. The meeting will be held on 23 and 24 April 2018, at the Palais des Nations in Geneva, Switzerland.

The UINL President, Mr. José Marqueño de Llano, asks all UINL member Notariats to participate actively in this technical meeting.

There will be simultaneous translation in Spanish, English and French.

The specific objectives of this meeting are:

  • Discuss the contributions of the Convention on the Rights of Persons with Disabilities in relation to legal capacity;
  • Identify the progress and challenges in the recognition of the legal capacity of persons with disabilities in the exercise of the notarial function;
  • Explore specific measures to improve the notarial function as concerns their role in upholding the right of persons with disabilities to exercise legal capacity;
  • Identify legal instruments that can be used by notaries to guarantee the exercise of rights by persons with disabilities;
  • Strengthen the collaboration between the international human rights mechanisms, notaries and organizations of persons with disabilities.

In her report Ms. Catalina Devandas Aguilar defines precisely the notariat as an authority for the implementation of the mandates of the Convention and underlines the necessity to form the notaries in civil-law countries about this topic.
