Autonomy of the will - identity of principle and diversity of implementation according to the 7th World Notariat University

The seventh edition of the UINL World Notariat University, whose final seminar was held in Rome from July 2 to 6, obtained once again the enthusiasm of all participants.

Indeed, the 2018 University brought together 75 students from 35 countries, representing North America, Central and South America, Asia and Europe, all united for a common purpose: studying “the Autonomy of the will”, meaning the freedom of parties to arrange their own affairs. 

This forum resulted in the active participation of students during an online preparatory cycle and, in boosted interactivity during the simultaneous translation sessions in Rome.

The project of the World Notariat University, turned towards the young notaries, allowed each participant, not only to realize, during constructive discussions, the similarities and the differences between their respective legal and notarial systems, but also to consider collective and harmonized solutions.

All of them understood the need to use the tools at their disposal, notably the UINL Forum, to better serve the notaries’ users, as international relations become extremely common.

Not. Thierry VACHON, Scientific Director of the World Notariat University, concludes: 

 « What immediately emerges is that the principle of the freedom of parties to arrange their own affairs actually permeates all areas of civil law. » but « this principle has influenced our legislations to a varying extent, largely permeating many areas of law or, on the contrary, remaining extremely limited, even ignored, in others. »

« The growing freedom of parties to arrange their own affairs requires that citizens make more and more choices, (...) and that they then take all ensuing responsibilities. »

« Here the role of the notary seems to be both natural and essential »
