A notarial guide of good practices for people with disabilities, provided to notaries all over the world

The International Union of Notaries has prepared and approved a Guide of Good Practices for notaries in relation to the attention and provision of notarial services to people with disabilities.

The text is based on Article 12 of the International Convention on the Rights of Persons with Disabilities, which recognizes the legal capacity of the vulnerable person to be the holder of rights and guarantee their exercise.

According to the report submitted to the General Assembly of the United Nations by the special rapporteur for the Rights of Persons with Disabilities, in December 2017, the notary is an authority that ensures the exercise of rights under equal conditions, and an institutional support: thanks to the notarial assistance, advice and support, this equality is made effective.

The Good Practices Guide is a tool that allows notaries to establish full recognition of the legal capacity of persons with disabilities, and that is available to all colleagues around the world as a necessary tool to carry out our task. From our closeness, with the disabled person, we are called to play the role of interpreter of their legal concerns before public and private authorities.

Given the principle of immediacy that governs our function and our proximity to citizens, we are called to play a role of authority and institutional support in responding to their legal concerns before public and private authorities.

Thus, the guide offers us concrete measures to broaden our spirit of discernment and better accompany vulnerable people in the exercise of their legal capacity; This will further facilitate their social inclusion, guaranteeing the equal exercise of rights for all human beings.

The UINL invites all notaries in the world, and in particular those from its member countries, to consult the guide and make it their own as a basic manual to guarantee the disabled person true and effective legal support.
