Interview with Marc GELEIJNS, President of the UINL International Task Force Civil Law -Common Law

The 3rd International Civil Law - Common Law Task Force (“ITF”) meeting will be held in Budapest on Thursday, October 25, 2018, thanks to the kindness and generosity of the Hungarian Notary Chamber.

The main purpose of this UINL Working Group, chaired by Not. Marc GELEIJNS, is to discuss topics and studies that compare and contrast laws and notarial practice within different countries, and, particularly, to enable members to have a better understanding on topics dealing with cross-border issues and to report developments in their own jurisdictions. 

The International Task Force has already organised two important meetings, first in London in 2015 on “Succession Law including the impact of EU Regulation 650/2012 in common law and mixed common law jurisdictions”; and then in Mauritius in 2016, on “The International Property Transmission”. 

For this 3rd meeting, which will be dealing with “Matrimonial Property Regimes, particularly with reference to the EU Regulations 2016/1103/1104”, we asked Marc GELEIJNS, President of the ITF to answer a few questions: 

 

1°) The International Task Force Civil Law-Common Law was created in order to discuss topics and studies that compare and contrast laws and notarial practice within countries of different legal traditions.

Could you let the readers know who is encouraged to participate to the ITF work sessions?

Not only UINL delegates are invited to participate at the meetings of the ITF, but also notaries from countries with a Common Law jurisdiction and representatives of their professional organisations. Local notaries of the country where the meeting is organized are welcome to participate, not only to get to know UINL better, but in particular to take advantage of the presence of highly qualified expert speakers at the conferences.

 

2°) This year’s theme is Matrimonial Property Regimes, particularly with reference to the EU Regulations 2016/1103/1104.

Could you let the readers know why this theme is a crucial cross-border matter?

It is an extremely hot topic: the new EU regulations will have quite an impact on marriages and registered partnerships if at least one of the partners lives within the EU. Since notaries are very much involved in advising couples on their matrimonial regime and draw up prenuptial and partnership agreements, it is essential that they keep up with actual developments and are very well aware of the new regulations.

 

3°) This year meeting is the 3rd ITF meeting.

Could you let the readers know what benefits result from such meetings?

The participants get a much better understanding of the topics discussed at the meeting and are encouraged to share experiences and to work together with notaries abroad in case their clients have of a cross border relationship. Besides, meeting colleagues from other countries and jurisdictions offers a great opportunity to expand their professional network.
